User Agreement - Introduction

Welcome to our online store. You will find below the terms and conditions that govern your use of this store and all the legal implications that result from using its services through this digital platform. Any person using the store, whether as a consumer of a product or service or otherwise, is deemed to have accepted and agreed—while fully competent under Sharia, statutory, and legal considerations—to all the terms and provisions of this Agreement. This confirms your commitment to the system it outlines. This Agreement applies to all forms of interaction between the consumer and the store and becomes effective immediately upon your acceptance and registration, in accordance with Article 10 of the Saudi Electronic Transactions Law.


Article One – Preamble and Definitions

The above preamble is an integral part of this Agreement. Below are the key terms and definitions used:

  1. (Store): This includes all forms of the store on the internet—whether a web application, website, physical store, or similar.
  2. (Consumer): A person engaging in e-commerce to obtain products or services provided by the store through its digital platform.
  3. (Agreement): Refers to the terms and conditions outlined herein, which regulate the relationship between the parties involved.

Article Two – Legal Capacity of the Consumer

  1. The consumer affirms that they are legally competent under Sharia and statutory law to interact with the store, or that they are at least 18 years of age.
  2. The consumer agrees to bear full responsibility for any consequences arising from a violation of this article.

Article Three – Nature of Obligation

  1. The store is obligated to provide the product to the consumer from the moment it is ordered until it is delivered to the consumer’s address.
  2. The store may also offer additional services, such as after-sales services, depending on the nature of the product or service requested.

Article Four – Usage Regulations

  1. The consumer agrees to use the store’s platform in accordance with public morals and applicable laws in Saudi Arabia.
  2. The consumer also agrees not to use any purchased service or product in a manner that violates public morals or Saudi laws.

Article Five – Accounts and Registration Responsibilities

Upon applying for membership in the store, you agree to disclose specific information and choose a username and password, thereby agreeing to:

  1. Be responsible for maintaining the confidentiality of your account and password, and notify the store immediately of any unauthorized use or security breach.
  2. The store is not responsible for any direct or indirect losses resulting from disclosure of your account information or password.
  3. You agree to use your account personally, and if someone else uses it, it is considered as having been authorized by you.
  4. Use the store seriously and truthfully.
  5. Provide accurate, up-to-date, complete, and legal personal information and update it as necessary.
  6. The store is committed to maintaining the confidentiality of your personal information and contact details.
  7. If the store finds that you provided false, outdated, incomplete, illegal, or otherwise misleading information, it reserves the right to suspend, freeze, or cancel your membership/account, without waiving its other legal rights.
  8. In case of any violation of the above, the store management may suspend or block your account or deny you access to the store’s services.

Article Six – Electronic Communication and Official Channels

  1. The parties agree that communication will be conducted via the email address registered on the platform.
  2. The consumer agrees that all agreements, notices, and communications provided electronically are legally binding and equivalent to written documentation.
  3. The consumer agrees to be notified of relevant terms or changes via public or direct notifications sent by the store.

Article Seven – Amendments and Fees

  1. If any provision of this Agreement is deemed invalid or unenforceable, the rest shall remain valid and in effect.
  2. This Agreement, which may be amended from time to time, represents the mutual understanding between the consumer and the store.
  3. The store may impose fees based on the products or services requested or based on applicable government taxes.
  4. The store reserves the right to add, increase, reduce, or discount any fees in accordance with this Agreement.

Article Eight – Payment Services

  1. The store, through its partners, offers various payment methods including full online payment or other methods introduced periodically.
  2. The store must list service/product prices based on prevailing market rates.
  3. The store is required to issue invoices and receipts for all transactions and provide the consumer with a purchase invoice.
  4. The store must adhere to standard accounting practices as stipulated by this Agreement to meet legal, economic, and commercial requirements.

Article Nine – Intellectual Property

  1. All intellectual property rights related to the store are fully owned by the store, whether acquired before or after the platform’s launch.
  2. The consumer agrees to respect the store’s intellectual property rights, including its name, logos, slogans, and any other identifying symbols.

Article Ten – Store Responsibility

  1. The store pledges to operate in accordance with the laws of Saudi Arabia and the provisions of this Agreement.
  2. The store bears no responsibility for claims resulting from errors or negligence by the consumer or third parties such as shipping companies.
  3. “Hasib & Dish” and its affiliates, owners, and representatives ensure that all products and services are legitimate, licensed, and used for lawful purposes in accordance with Saudi laws.

Article Eleven – Account Restriction or Suspension

The store reserves the right to suspend or cancel a consumer’s membership or access to the platform at any time, for any reason, and without prior notice.


Article Twelve – Governing Law

This Agreement is governed by the laws and regulations of the Kingdom of Saudi Arabia and is fully subject to the relevant authorities therein.


Article Thirteen – General Provisions

If any provision of this Agreement becomes invalid, the remaining provisions shall remain in effect until further notice from store management.


Summary

This User Agreement—subject to change when necessary—represents the binding contract between the store and the consumer. Both parties agree to the following:

  1. Arabic is the official language for interpreting and translating the terms of this Agreement.
  2. Product and service prices may change from time to time.
  3. Promotional offers may be temporary, and the store reserves the right to modify or cancel them at any time.
  4. Both parties agree to conduct themselves in accordance with Islamic principles, laws, and regulations governing commercial transactions in Saudi Arabia.
  5. This Agreement may only be terminated by a decision from the store’s management.
